Mediation is the process by which a disinterested neutral party guides the parties to the dispute in crafting their own solution. Mediation is binding only if the parties agree. This provides an advantage over litigation in that it will likely result in speedier resolution and significant cost savings, as well as giving the parties confidentiality and complete flexibility in determining their own result. In a business context this can help preserve business relationships which can advantage both parties later on.
Your mediator should be experienced, trained in mediation and preferably have a certification from one or more courts or other agencies. A good mediator need not have subject matter expertise in the area of the dispute but it often helps him or her grasp the details of the dispute more quickly. There are many styles of mediation and every mediator has his or her own personality. You should feel free to interview any mediator you may be considering as to his or her philosophy, style, knowledge and experience.

In recent years I have brought my experience as an advocate and began serving as a mediator to help others resolve disputes efficiently. I have been trained as a mediator and am approved by the Supreme Court of Kansas to be appointed as a mediator as well as being on the mediation panel for the US District Court for the Western District of Missouri.
